Paris, France - Last week the Conseil D'etat, France's highest court, ruled that the ban against the turban in schools was legal because there was a greater interest to be served in preserving secularity than a religious belief.

Exactly three years after Bikramjit Singh, Jasvir Singh and Ranjit Singh were expelled from the Louise-Michel High School of Bobigny (Seine-Saint-Denis), the Conseil d'Etat ruled on 5th December 2007 that the keski , the under-turban they wore to school, was not a discreet sign but an ostensible manifestation of religion which is prohibited by the French law dated 15 March 2004.

Lawyers acting for the 3 boys, who had been instructed by UNITED SIKHS and the French Turban Action Committee, had argued before the Conseil d'Etat that the expulsion of the 3 schoolboys had infringed article 9 and article 14 of the European Convention of Human Rights, which provided for the freedom to manifest one's religion and the right not to be discriminated, respectively.

Under article 9(2), of the Convention, the right to manifest one's religion can only be limited on grounds of public safety, security and health.

The Conseil d'Etat concluded that in the interest of secularism in public schools, the permanent expulsion of a student who does not conform to the legal ban on wearing of ostensible religious signs "does not lead to an excessive infringement upon the freedom of thought, conscience and religion guaranteed by Article 9".

Further, the Conseil d'Etat said that since the ban applied to all religions signs, it was not discriminatory against the Sikhs, under article 14.

Even though the ban on religious signs in schools affected all religious communities, the ban has only been challenged by 6 Sikh French schoolboys to date. Three of Sikh boys were expelled in the years following the first expulsions.

"UNITED SIKHS has instructed Stephen Grosz, Rabinder Singh QC and junior counsel Schona Jolly to file the appeals to the European Court of Human Rights and the UN Human Rights Committee (UNHRC)," said Mejindarpal Kaur, UNITED SIKHS director who has led the Right To Turban campaign since 2004.

"We will be seeking to file the appeals on behalf of all the 6 schoolboys in the European Human Rights Court and the UNHRC by late January," she added.

"We will go to the ends to meet our objective and will never remove our Turbans," said Gurdial Singh, head of the French Turban Action Committee, who is also the father of one of the expelled schoolboys. "If the French courts cannot give us justice, we have faith that the international courts will understand that the turban is an integral part of a Sikh and banning it is a substantial violation of a Sikh's right to practice his faith,"said Shingara Singh, UNITED SIKHS director. Shingara Singh's case was filed by UNITED SIKHS at the European Human Rights Court last June and his passport case will be filed with the UN HRC in the next few months. French authorities refused to issue Shingara Singh's replacement driving licence and French passport because he refused to remove his turban for his ID photos.

"Having taken note of French President, M Sarkozy's call for diversity in the United Nations Assembly last September, this judgment appears disappointing even if it is not a surprise to me," said Kudrat Singh, who has been in the forefront of the Right To Turban campaign in France.

"I can only say that this judgment confirms the dysfunctional treatment of Sikhs by a "country with a proud tradition of Human Rights', for the last 5 years, " he added.

On 25th Sept 2007, French President Nicolas Sarkozy had called for respect for diversity, national identities, religion, beliefs and cultures during his address to the UN General Assembly in New York.

He had said, "Attachment to one's faith, to one's language and culture, and to one's way of life, thought and belief - all this is natural, legitimate and profoundly human."

"To deny that is to sow the seeds of humiliation. It stokes the fires of the very nationalism, fanaticism and terrorism we claim to be fighting." A "clash of civilizations," he said, "will not be averted by forcing everyone to think and believe alike; cultural and religious diversity must be accepted everywhere and by all."

The UN, he said, embodies no one religious belief or ideology. "It embodies what is universal in all ideologies, all religions, all beliefs... which is why it is the only place in the world where all people can speak to one another and understand each other."

De Commissie Gelijke Behandeling (CGB) schrijft in een advies aan minister Ter Horst van Binnenlandse Zaken dat kledingvoorschriften die ervoor zorgen dat de politie neutraal overkomt, kunnen leiden tot uitsluiting van agenten op basis van hun geloof. Het dragen van hoofddoekjes, keppeltjes en kruisjes mag daarom alleen aan de hand van sterke argumenten worden verboden. De minister wil de kledingvoorschriften voor de politie uit 1994 vernieuwen. De bestaande regels maken niet duidelijk welke geloofsuitingen zijn toegestaan. Daardoor mag een islamitische agente in het ene korps wel een hoofddoek dragen en bij de politie elders in het land niet. De commissie vraagt de minister om met goede argumenten te komen als ze een neutraliteitscriterium invoert, omdat het indirect kan botsen met grondrechten, met name het verbod op discriminatie en de godsdienstvrijheid. ‘Een inventarisatie van de politiekledingvoorschriften in landen zoals Canada en Groot-Brittannië leert dat in deze landen de tulband een geaccepteerd onderdeel van het uniform is. In Groot-Brittannië is ook de hoofddoek toegestaan voor agentes. Wij vragen de minister deze voorbeelden in haar afweging te betrekken’, stelt CGB-voorzitter mr. A. G. Castermans

Gezocht: hindoe- en moslimspionnen. Dat was de boodschap van een zeldzaam kijkje in de keuken van de Britse inlichtingendienst MI5.

In een van tevoren in Londen opgenomen radioreportage voor de Aziatische nieuwsradio van de BBC vertelden ‘Jayshree’ en ‘Shahzad’, twee allochtone agenten van MI5, hoe zij proberen Britse jongeren van Aziatische afkomst te rekruteren. Het was voor het eerst in het bijna honderdjarig bestaan van MI5 dat agenten een interview gaven.

De pr-stunt lijkt meer dan alleen een politiek correcte stap van MI5 om het huidige percentage allochtone werknemers op te schroeven. Dat staat nu op 6,5 procent. De veiligheidsdienst is al langer hard op zoek naar agenten onder de tweede generatie immigranten uit Azië in verband met de potentiële dreigingen die van die ruim twee miljoen koppen tellende gemeenschap uitgaan.

Volgens MI5-chef Evans lopen er zeker 2.000 potentiële terroristen rond in Groot-Brittannië. In 2011 moet het aantal agenten daarom zijn verhoogd van 3.000 naar 4.000, van wie een fors aantal hindoes, moslims en sikhs. Die zouden, beter dan autochtone Britse agenten, belangrijke informatie kunnen geven over slapende terroristische cellen.

HASSELT (RKnieuws.net) - Een Indisch echtpaar is door de rechtbank in Hasselt vrjgesproken van verboden wapendracht. Het paar, dat tot de Sikhgemeenschap behoort, was naar de tempel in Hoepertingen gereden om er de eredienst bij te wonen. De man en de vrouw droegen een kleine ’kirpan’, een dolk die bij Sikhs als religieus symbool geldt, onder de kleren.

Het paar krijgt de kirpans terug en de gerechtskosten zijn ten laste van de Staat.

Vorig jaar verkreeg de advocaat van het paar ook al een vrijspraak in een soortgelijke zaak. De openbare aanklager tekende toen beroep aan maar het Antwerpse Hof van Beroep bevestigde het eerste vonnis. (tb)

India moet verantwoordelijken voor moorden en verdwijningen berechten

24 oktober 2007 (MO) - In Kashmir en in het noordoosten van India klagen afscheidingsbewegingen over de hardhandige manier waarop de centrale overheid en het leger de eenheid van India handhaven. Die ijzeren-vuist-politiek is niet nieuw. Dat blijkt uit een nieuw rapport waarin de blijvende straffeloosheid van de vuile oorlog tegen de Sikh-separatisten uit de jaren 1980 aangeklaagd wordt.

De Indiase deelstaat Punjab wou in 1980 meer lokale autonomie verwerven, maar stootte op een njet uit Delhi. Daarop reageerden ontevreden Sikh separatisten met bomaanslagen en gewapend verzet. Het geweld bereikte een hoogtepunt op 4 juni 1984, toen het Indiase leger de Gouden Tempel van Amritsar -de Harmandir Sahib- binnenviel en er duizenden mensen vermoordde. De spiraal van geweld ging nog verder toen Sikh-separatisten reageerden met een aanslag op toenmalig premier Indira Gandhi, wat dan weer aanleiding was tot een ware pogrom tegen Sikhs in Delhi en de rest van het land.

Human Rights Watch en Ensaaf -een Indiase mensenrechtenorganisatie- schrijven dat politieagenten tijdens de jaren van deze "vuile oorlog" een beloning kregen telkens Sikh-militanten gearresteerd of omgebracht werden, waardoor het aantal moorden en verdwijningen nog toenam. Gedurende een periode van bijna tien jaar werden door de Indiase regering elementaire mensenrechten geschonden en tienduizenden mensen vermoord, aldus Protecting the Killers, het rapport van Human Rights Watch en Ensaaf.

Het rapport klaagt vooral het feit aan dat de Indiase regering nog steeds niemand ter verantwoording geroepen heeft. Al bijna drie decennia slaagt het Central Bureau of Investigation van India er niet in om de feiten te onderzoeken of te bewijzen. De duizenden slachtoffers en hun families worden geconfronteerd met langgerekte processen, bevooroordeelde aanklagers en intimidatie.

In Protecting the Killers stellen HRW en Ensaaf dat de straffeloosheid moet stoppen en dat degenen die verantwoordelijken waren voor de moorden en verdwijningen in Punjab vervolgd moeten worden. 'De Indiase regering mag niet geloven dat deze misdaden zullen opgaan in de mist van de geschiedenis.' Het belang van diepgaand onderzoek en gerechtigheid is volgens de organisaties overigens ook groot voor al wie vandaag opkomt voor mensenrechten in delen van India waar conflicten woeden.

Washington: Sikh air passengers will no longer have to remove their turbans at US screening checkpoints if doing so makes them uncomfortable under new guidelines coming into force October 27.

The new Transportation Security Administration (TSA) guidelines announced on Tuesday give airport screeners the option to pat down headwear at the metal detector if a passenger does not want to remove it for personal reasons.

Experts say mixing up the screening techniques is good security. "We must use security measures that are unpredictable, agile," TSA Administrator Kip Hawley told a Senate panel on Tuesday.

New York based Sikh Coalition, a leading US Sikh civil rights organisation, welcomed the change because it both protects national security and is respectful of religious pluralism. But it also asked the TSA to create safeguards that provide better protection against religious profiling.

Under the new policy, a Sikh, or any person wearing religious headwear can pat down his or her own head covering, and then have their hands swabbed with a cotton cloth to check for chemical residue.

The new policy is a direct response to Sikh concerns, raised after the TSA in August listed "bulky" headwear such as cowboy hats, berets or turbans should be patted down.

The TSA has now removed turbans from its screener guidance. In addition, the TSA will provide all its field employees with mandatory cultural awareness training about Sikh practices.

The Sikh Coalition said it nevertheless remains concerned that screeners have sole discretion to decide when to perform additional screening. Screeners may pull aside passengers for additional screening if they believe the person's head covering to be "bulky".

"While the TSA has assured us that trainings and supervisor oversight will stem improper use of this discretion, the Sikh Coalition is unconvinced that this is the best solution," It said.

Asking TSA to collect data with regards to additional screenings in US airports to ensure that screeners are not profiling, the coalition said it was also concerned that Sikh travellers have to assert that they do not want their turbans touched by a screening officer.

"As we understand it, the TSA is not requiring screeners to inform passengers that they have a right to conduct a self-pat-down, although this is the stated policy.

"We are encouraged that the TSA has found a solution that does not single out turbans for additional screening. Indeed, it is possible to secure America's safety and be true to the principles of religious freedom," said Amardeep Singh, executive director of the Sikh Coalition.

"Still, we call on the TSA to implement safeguards that make good on its 'no profiling' pledge."

In a recent informal poll conducted by the Sikh Coalition, over 77 per cent of Sikhs placed air travel among the five most important issues the community faces in the US. It ranked second only to hate crimes.

The Sikh Coalition hopes that the TSA will continue to work with it in the coming months to eliminate the Sikh community's concerns about traveling in the US, it said.

Paris: Sikhs have opened a school catering exclusively to the community near the French capital in the wake of tough laws banning the wearing of traditional turbans in public schools.

The school in Bobigny opened on Saturday. Sikh men are required by religion to cover their hair at all times by a turban, an article of faith and an intrinsic aspect of their identity.

Six Sikh boys have been expelled from French schools since the controversial law banning religious symbols was passed in 2004. Several Sikh boys have dropped out of mainstream education in protest.

A Sikh entrepreneur whose son was one of those expelled after he refused to remove his turban in class built the new school, BBC reported. Some 10,000 Sikhs live in France.

It is hoped that a Sikh college will open later this year to allow older Sikh boys to pursue higher education without any hindrance.

In June, the Sikh community in France filed a case before the European Court of Human Rights in Strasbourg after Shingara Mann Singh, 52, a French national for over 20 years, was refused a replacement driver's licence in 2005 and again in 2006 after he declined to remove his headgear

Agenten op Amerikaanse luchthavens hebben het recht gekregen om de tulband te fouilleren bij veiligheidscontroles. Dit kan ook wanneer de betrokkene al door een metaaldetector is gegaan. Het geloof van de sikhs verbiedt de mannen om hun haar te knippen en legt hen op hun haren te bedekken met een tulband. De vertegenwoordigers van de sikh-gemeenschap in de VS reageren verontwaardigd.

Behandeling per religie
"De maatregel laat de veiligheidsagenten toe om de reizigers op verschillende manieren te behandelen naargelang hun religie", meent een verontwaardigde Amardeep Singh, voorzitter van de sikhvereniging Coalition sikh. Volgens hem wil dat voor het publiek ongeveer hetzelfde zeggen als: "wie een tulband draagt is gevaarlijk". Dergelijke maatregel druist in tegen "de geest van het pluralisme waarin dit land is ontstaan".

Discriminatie? Onmogelijk!
Het agentschap voor 'Veiligheid in het verkeer' stelt dat de maatregel niets te maken heeft met religieuze voorkeur van de reizigers. "We hanteren geen criteria die betrekking hebben op ras of religie maar bouwen daarentegen garanties in om ons ervan te verzekeren dat dergelijke discriminatie niet mogelijk is", aldus een woordvoerster van het agentschap, Lara Uselding.

Geen moslims
De Coalition sikh werd na de aanslagen van 11 september opgericht om de Amerikanen vertrouwd te maken met de sikh-religie. Na de aanslagen werden immers meerdere sikhs aangevallen in New York omdat ze verward werden met moslims. (afp)
